Are you eligible?

Each expungement case is different. But they all more or less begin in the same fashion. I person that has been convicted of a crime calls our office with questions. We begin by consulting the statute on expungement in Kansas to see if the person is eligible to get their case expunged. We need to know the following information.

1. What crime were you convicted of?
2. What probation or prison sentence did you serve?
3. How much time has passed since you served that sentence or were released from probation?
4. Have you been convicted of any other crimes since you served that sentence?
5. Did you pay all your restitution and fines on the case?
6. What have you done since the conviction to better yourself?
7. What jurisdiction did you get the conviction?

After we have the answers to those questions we can tell you if you are eligible to get the record expunged and how likely or unlikely you will be successful. After the initial consult and you retain our services we go to work on your case.

How do I expunge an arrest record?

Anytime you are arrested a record will be created of your arrest. Even for cases of mistaken identity or for a crime you were completely innocent of. Those records are out there and they can cause problems. These records can be expunged as well and should be as soon as reasonably possible. The process is very similar to the process for expunging a criminal conviction with only a few minor differences. The time frame for expungement is not proscribed by statute and generally these records are easier to expunge and less likely to be contested by the prosecutor's office. If you need an arrest record expunged contact our office for a free consultation. Expungement takes time, don't wait until you have a job offer pending a background check to call.

Expungement of Dismissed Cases

If you have been charged with a crime a record is maintained by the court. Even on cases that are dismissed, a record is maintained. When an employer runs a background check many will not look to see if you were actually convicted or the case was dismissed. You don't want to start a job under a cloud of impropriety due to a prior criminal charge. We expunge dismissed cases and can help you clean up the paper trail of your past criminal charge.
